In a significant development for the cannabis industry, Florida election officials have confirmed that a proposed constitutional amendment to legalize adult-use marijuana will advance to the November 2026 ballot. This progression follows a contentious legal battle, as the campaign group Smart & Safe Florida alleged that the administration of Governor Ron DeSantis attempted to derail the initiative. The state's Division of Elections Director, Maria Matthews, verified that the group had collected enough signatures to move forward, a decision that marks a critical step in the legalization process

The confirmation of sufficient signatures came after a lawsuit was filed by Smart & Safe Florida, accusing the state of attempting to sabotage their efforts. Attorney General James Uthmeier has since requested the state Supreme Court to dismiss the lawsuit, asserting that the state's compliance with the campaign's demands renders the lawsuit moot. The proposal will now undergo a review by the attorney general, who will pass it to the Supreme Court to examine its language, ensuring it meets legal standards for the ballot

This is not the first legal hurdle Smart & Safe has faced. Previously, they filed a lawsuit in October challenging the state's decision to discard nearly 200,000 signatures. The campaign needs to gather a total of 880,000 valid signatures to secure a place on the ballot. Florida's medical marijuana market, valued at $1.8 billion annually, represents a significant opportunity for the cannabis industry, making the state's adult-use legalization a highly coveted goal

Smart & Safe Florida's efforts are backed by substantial financial support from medical marijuana companies, notably Trulieve Cannabis Corp., which has contributed $25.8 million to the current campaign. The 2024 attempt to legalize recreational cannabis fell short, with over 56% voter support, just below the 60% threshold required. Meanwhile, allegations persist against Governor DeSantis and other officials for allegedly using state resources to oppose the 2024 initiative, with a grand jury reportedly investigating these claims
