Nebraska Supreme Court Reviews Challenge to Medical Marijuana Legalization

The Nebraska Supreme Court is currently deliberating on a case that could potentially reverse the state's medical marijuana legalization. The lawsuit, filed by former state lawmaker John Kuehn, alleges that fraudulent practices were used in gathering signatures for the ballot measures that led to the legalization. This legal challenge comes despite the overwhelming approval of the measures by voters last November

Kuehn, who co-founded the anti-legalization group Smart Approaches to Marijuana, initially brought his case to a lower court, which dismissed his claims of fraud. However, he has since appealed to the high court, seeking a second phase of trial to substantiate his allegations. His attorney, Zachary Pohlman, argued before the court that the sponsors of the ballot initiative should be required to demonstrate the validity of the signatures collected

The controversy has created a ripple effect among Nebraska lawmakers, some of whom are now hesitant to engage with medical cannabis regulation. Despite the Secretary of State Bob Evnen certifying the election results, the lawsuit has led to delays in the implementation of medical cannabis licensing and cultivation. Governor Jim Pillen and Attorney General Mike Hilgers have both expressed concerns about the legality of the measures under state and federal law
