In a significant move to address past injustices, Washington State has launched an online portal to facilitate the refund of legal fees for individuals convicted under drug laws deemed unconstitutional by the state's Supreme Court in 2021. Blake, which found the state's drug possession laws unconstitutional due to the absence of a requirement for proof of intentional possession
The Blake Refund Bureau, unveiled by the Administrative Office of the Courts (AOC), aims to streamline the refund process. This new platform is designed to coordinate efforts with county clerks, public defenders, prosecutors, and other stakeholders to ensure affected individuals can have their convictions vacated and receive financial restitution
According to the AOC, individuals with convictions impacted by the Blake decision must first have their records cleared by the courts that issued them. Once vacated, these individuals can apply for reimbursement of legal financial obligations incurred under the invalidated laws, providing relief to those unjustly penalized
