Louisiana Senate Approves Bill Allowing Terminal Patients to Use Medical Marijuana in Hospitals

The Louisiana Senate has overwhelmingly passed legislation that would permit terminally ill patients to use medical marijuana within hospital settings. Senate Bill 270, authored by Sen. Katrina Jackson-Andrews (D), was approved in a 33-2 vote and now moves to the House of Representatives for further consideration. The bill specifically targets patients with terminal and irreversible medical conditions who already have prescriptions for medical cannabis

According to the bill, patients or their primary caregivers would be allowed to bring prescribed medical marijuana into hospitals and administer it themselves or with the help of a family member. "This bill does exactly what the title says," Jackson-Andrews stated during the Senate floor debate. "When a patient is in pain and they believe that therapeutic marijuana will work and have a prescription for it, it allows them to have that prescription delivered to the hospital and administered by one of their family members or themselves."

The legislation stipulates that hospitals must establish written policies for on-site use of medical cannabis, with the caveat that smoking and vaping are not permitted. An amendment ensures that emergency and outpatient departments are excluded from this requirement. Additionally, the bill makes clear that all responsibility for obtaining, storing, and administering the medical marijuana falls to the patient or their caregiver, with the product required to be kept in a locked container supplied by the patient. Hospital staff are explicitly barred from handling or administering the medication

The proposal also includes a safeguard allowing hospitals to opt out of the policy if federal authorities take enforcement actions against any Louisiana healthcare facility over medical cannabis use. Jackson-Andrews emphasized that the legislation was introduced at the request of constituents seeking greater comfort options for terminally ill patients. Meanwhile, Louisiana lawmakers are also advancing other measures related to psychedelic-assisted therapy and adult-use cannabis pilot programs, reflecting a broader shift in the state's approach to drug policy reform
